TERMS & CONDITIONS

Hello, thank you for actually taking the time to read our terms and conditions. We have tried to write these in normal English as we’re fed up having to read screeds of opaque language. So here goes:

The Ceilidh Club is owned by Ceilidh Club Ltd a company registered in Scotland under the number 207859. The registered office is 606 Old Dalkeith Road, Edinburgh, EH16 4SN. The VAT number for Ceilidh Club Ltd is 905016756

Overview
1.1 We sell tickets to our events only.

1.2 We arrange corporate events too, providing bands/venues and ancillary services through 3rd parties. As well as the points underneath please also see point 14 with regard to this particular service. 

1.3 For specific terms relating to the Whisky course please see section 16.

CONTRACT
2.1 Any purchase of an Item from us is subject to: (i) this Purchase Policy; (ii) any special terms and conditions which may be displayed on our website; (iii) the terms and conditions of the venues which you can read on their websites and the iv) the terms and conditions from any 3rd party supplier which you can read on their websites.
2.2 Your contract for the purchase of an Item starts once we have confirmed your purchase and ends immediately after the completion of the event for which you have purchased the Item, all purchases are subject to payment card verification and other security checks and your transaction may be cancelled if it has not passed our verification process.
2.3 We reserve the right to cancel bookings which we reasonably suspect to have been made fraudulently.

PRICES AND FEES
3.1 Purchases from us may be subject to a per Item service charge and a non-refundable per order delivery fee.
3.2 We try to ensure that the prices on our website are accurate. However, errors may occur. If we see that an error has occurred we will contact you as soon as possible and give you the option of reconfirming your purchase at the right price or cancelling your order. If we are unable to contact you, you agree that we may treat the order as cancelled. If you choose to cancel after you have already paid the incorrect price, you will receive a full refund from us.

CANCELLATIONS
4.1 If you have purchased a ticket or service, you are not entitled to cancel your purchase. Tickets/services are sold on a non-refundable non-transferrable basis.

DELIVERY
5.1 Our tickets are virtual. Please bring along your Paypal / Stripe receipt with you on the night. You may also receive from us tickets that can be printed off. It is not necessary to bring these along as your Paypal / Stripe receipt is proof of purchase.

TICKETS
6.1 Any ticket you purchase from us remains the property of the Ceilidh Club and is a personal revocable licence which may be withdrawn and admission refused at any time. If this occurs, you will be refunded the sale price of the ticket which has been withdrawn or for which access was refused (including the relevant per ticket service charge but excluding the per order handling fee).
6.2 Please keep your Paypal / Stripe receipt safe. We will not be responsible for any receipts that are lost or stolen.
6.3 It is your responsibility to check your tickets; mistakes cannot always be rectified.

RESTRICTIONS
7. 1 A ticket shall not be used for advertising, promotions, contests or sweepstakes, unless formal written permission is given by the Ceilidh Club, provided that even if such consent is obtained, use of our trademarks and other intellectual property is subject to our prior consent.

EVENT
8.1 It is your responsibility to ascertain whether an event has been cancelled and the date and time of any rearranged event. If an event is cancelled or rescheduled, we will use reasonable endeavours to notify you. We do not guarantee that you will be informed of such cancellation before the date of the event.
8.2 Please note that advertised start times of events are subject to change.
8.3 Tickets are sold subject to our right to alter or vary the programme due to events or circumstances beyond its reasonable control without being obliged to refund monies or exchange tickets.

REFUNDS
9.1 Occasionally events are cancelled, rescheduled or materially altered for a variety of reasons. Contact us for exact instructions.
9.2 Cancellation: If an event is cancelled (and not rescheduled), you will be offered a refund of the sale price of your ticket(s), including the relevant per ticket service charge but excluding the per order handling fee.
9.3 Rescheduling: Unless indicated otherwise in relation to a particular event, if an event is rescheduled, you will be offered places at any rescheduled event (subject to availability) of a value corresponding with your original tickets. If you are unable to attend the rescheduled event, you will be offered a refund of the sale price of your ticket(s) including the relevant per ticket service charge but excluding the per order handling fee. You must inform us within the time specified by us if you are unable to attend the rescheduled event, otherwise, we may reconfirm your booking for the rescheduled date and you will not be entitled to claim a refund.
9.4 In the event of a cancellation we will refund your monies via your original payment method.
9.5 This Purchase Policy does not and shall not affect your statutory rights as a consumer. For further information about your statutory rights contact Citizens Advice.
9.6 We regret that, unless paragraphs 8.2 or 8.3  apply, tickets cannot be exchanged or refunded after purchase.

LIABILITY
10.1 Personal arrangements including travel, accommodation or hospitality relating to the Event which has been arranged by you are at your own risk. We shall not be liable to you for any loss of enjoyment or wasted expenditure.
10.2 Unless otherwise stated in this clause 9, our liability to you in connection with the event (including, but not limited to, for any cancellation, rescheduling or material change to the programme of the event) and the Item you have purchased shall be limited to the price paid by you for the Item, including any per item service charge but excluding any per order handling fee.
10.3. We will not be liable for any loss, injury or damage to any person (including you) or property howsoever caused (including by us): (a) in any circumstances where there is no breach of a legal duty of care owed by us; (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury resulting from our negligence); or (c) to the extent that any increase in any loss or damage results from breach by you of any of the terms of this Purchase Policy and/or any terms and conditions or your negligence. Note: participation at our events can be vigorous. It is possible to slip and trip and injure yourself. The Ceilidh Club takes no responsibility for any injury incurred. You undertake any participation at your own risk. 

10.4 Nothing in this Purchase Policy seeks to exclude or limit our liability for death or personal injury caused by our negligence, fraud or other types of liability which cannot by law be excluded or limited.

ADMISSION AND ATTENDANCE
11.1 The venue reserves the right to refuse admission should patrons breach any terms and conditions of the event. The venue may on occasions have to conduct security searches to ensure the safety of the patrons. The management reserves to refuse admission or to ask anyone to leave who is deemed by the management to be acting inappropriately. 
11.2  Pass-outs or re-admissions are at the discretion of the management.
11.3. The unauthorised use of photographic and recording equipment is prohibited. Any photos, videos and/or recordings may be destroyed or deleted. Laser pens, mobile phones, dogs (except guide dogs) and own food and drink may also be prohibited (please check with the venue). Please note that you are not allowed to consume alcohol purchase outside of the venue.
11.4 You and other ticket holders consent to film and sound recording as members of the audience. You may also be photographed for use on social media and publicity.  If you see a photograph or video of you in it and you do not wish this to be used then please contact us and we will remove it. 
11.5. Prolonged exposure to noise may damage your hearing.
11.6. Special effects which may include, without limitation, sound, audiovisual, pyrotechnic effects or lighting effects may be featured at an event.

11.7 If you are bringing children to any Ceilidh Club event then you acknowledge that the parent / guardian / carer has, at all times, the duty of care for the child. For avoidance of doubt the Ceilidh Club is not the parent / guardian / carer of any child. 

DATA USAGE AND CONSENT

12.1 Ceilidh Club Limited is registered under the Data Protection Register number Z684346X. We comply with the General Data Protection Regulation (GDPR) 2018.

12.2 We collect the following mandatory information when you make a booking: name, address, telephone number, IP address and postcode. If you sign up for an account you may leave other non-mandatory information at your discretion. The financial transaction is handled by the payment providers PayPal or Stripe. We do not hold any of your financial data on our servers.  We do not have access to your financial details other than the last 4 digits of your payment card (if used) and the expiry date. Only the data controller, Ed McCabe has access to this information. 

12.3 Our servers are located in the UK and encrypted. 

12.4 We will send you an email confirmation of your order and potentially other email correspondence about your order/event. We may send you a questionnaire after the event to solicit feedback. 

12.5 You may voluntarily sign up to a newsletter via our website and your email address is stored in encrypted servers located in the US with companies that are Privacy Shield compliant. Any newsletters sent to you will have an unsubscribe button.

12.6 We may collect information by cookies to help with administration, performance of the website and marketing. 

QUERIES AND COMPLAINT
13.1 If you have any queries or complaints regarding your purchase, contact us, quoting your order number given to you at the conclusion of placing the order.
13.2 We aim to resolve all complaints within 7 days, where reasonably possible.
13.3. If any dispute arises, we shall use our reasonable endeavours to consult or negotiate in good faith and attempt to reach a just and equitable settlement satisfactory to you.

PROVISION OF BANDS/VENUES AND ANCILLARY SERVICES THROUGH 3RD PARTIES. 
14.1 Should any band/venue/ancillary service cancel we will endeavour to find a replacement. However, no guarantee can be given. 

MISCELLANEOUS
15.1 All of these terms and conditions are governed by Scots Law and any disputes arising out of any transaction with Ceilidh Club Ltd are subject to the exclusive jurisdiction of the Scottish Courts.

WHISKY COURSE

16.1 You warrant that you are over 18 years of age.

16.2 You have 7 days from the date of purchase to ask for a full refund.

16.3 Elements of the course are available from enrolment, other elements are available after 7 days.

16.4 You agree to an email being sent to you asking for feedback about the course.
